Personal Data Processing

In accordance with the Law of Ukraine No. 2297-VI of 01.06.2010

Terms and procedure for the collection, processing and storage of personal data of users of the mario.ua website.

I, in accordance with the Law of Ukraine “On Personal Data Protection” No. 2297-VI of 01.06.2010 (as amended and supplemented), hereby give my unambiguous consent to TOV “VP “Radiator” (hereinafter — the Owner) to the processing, use and storage of my personal data collected through the website https://mario.ua/ (hereinafter — the Website) in the ways determined by the legislation of Ukraine and this Consent.

Personal Data Transferred

Name, telephone number, e-mail — data confirming the identification of the User, transferred by means of the Owner's information and telecommunication system of personal data.

The said data are processed for the purpose of:

  • improving the operation of the Website and increasing its ease of use;
  • providing solutions and services that best meet the User's needs;
  • determining the User's preferences and displaying relevant materials;
  • providing targeted information about the solutions and services of the Owner and its partners;
  • targeted advertising based on preferences/actions on the Website (Facebook, Instagram, etc.);
  • ensuring the technical possibility of the Website's operation;
  • implementing relations in the field of information security;
  • ensuring the exercise of rights and obligations established by law in the field of information exchange.

By clicking the “Send” button on the Website or ticking the box “I agree to the collection and processing of my personal data”, the User, being a natural person and a personal data subject, gives his/her unconditional consent to the collection and processing of personal data under the terms set out below in accordance with the Law of Ukraine “On Personal Data Protection” of 01.06.2010, No. 2297-VI.

  1. The Owner processes the User's personal data by any means for the purpose of the proper provision of services (identification, authentication, authorisation, password recovery, sending information materials subject to consent, responding to requests and letters, leaving feedback on the quality of service, receiving advertising and special offers, and other information about the Owner's activities).
  2. Processing of personal data shall mean the collection, registration, accumulation, storage, adaptation, clarification (updating, modification), use, dissemination (including transfer to third parties), depersonalisation, destruction and other actions (operations) with personal data. The User undertakes, in the event of any change in personal data, to provide updated information as soon as possible.
  3. The Owner includes the User's data from the moment the User first provides (sends) his/her personal data to the Owner by completing the registration form or the order form on the Owner's Website.
  4. The database Owner does not notify the personal data subject of the transfer of his/her personal data in the cases provided for by the Law of Ukraine “On Personal Data Protection”.

Third Parties and Their Services

While using the Website, codes of third-party internet resources may be present, as a result of which such third parties receive the personal data specified above. Such internet resources are:

  • systems for collecting website visit statistics (for example, Google Analytics and others);
  • social plugins (widgets) of social networks (for example, Facebook and others);
  • banner display systems and other advertising services;
  • other resources required for the technical operation of the Website.

Rights of the User

Prior to granting this Consent, the User has been informed of his/her rights provided for by Law No. 2297, namely:

  1. to know the sources of collection and the location of his/her personal data, the purpose of their processing, the location and/or place of residence (stay) of the Owner or processor of personal data, or to give an appropriate instruction to authorised persons to obtain this information, except in cases established by the Law;
  2. to receive information on the conditions of granting access to personal data, in particular information about third parties to whom personal data are transferred;
  3. to access his/her personal data;
  4. to receive, no later than 30 calendar days from the date of receipt of the request, except in cases provided for by law, a response as to whether personal data are being processed, and to receive the content of such personal data;
  5. to submit to the personal data Owner a reasoned demand objecting to the processing of his/her personal data;
  6. to submit a reasoned demand for the modification or destruction of his/her personal data by any Owner and processor of personal data if such data are processed unlawfully or are inaccurate;
  7. to protection of his/her personal data against unlawful processing and accidental loss, destruction or damage due to intentional concealment, failure to provide or untimely provision thereof, as well as to protection against the provision of information that is inaccurate or discredits the honour, dignity and business reputation of a natural person;
  8. to file complaints about the processing of his/her personal data with public authorities and officials, with the Ukrainian Parliament Commissioner for Human Rights, or with a court;
  9. to apply legal remedies in the event of a violation of the legislation on personal data protection;
  10. to make reservations regarding the restriction of the right to process his/her personal data when giving consent;
  11. to withdraw consent to the processing of personal data;
  12. to know the mechanism of automatic processing of personal data;
  13. to protection against an automated decision that has legal consequences for the User.

Processing and Storage Period

Personal data are processed and stored throughout the entire period corresponding to the purpose specified in this Consent.

This Consent enters into force on the date it is granted by the User.

Confirmation by the User

By ticking the relevant box “I agree to the collection and processing of my personal data” on the Website page, the User confirms that he/she has been notified of the inclusion of information about him/her in the personal data database for the above purpose, of his/her rights established by the Law of Ukraine “On Personal Data Protection”, and of the persons to whom the data are transferred to fulfil the above purpose.
